Terms of Service

Effective 28 October 2026 Last updated 28 October 2026 Mintcast Studio Limited

These terms are the agreement between you and Mintcast Studio Limited for the use of the Mintcast website, the Mintcast mobile apps and the Mintcast desktop app. By creating an account, installing an app, or buying a plan, you accept them. If you do not accept them, do not use the software.

1. The parties

The software and this website are provided by Mintcast Studio Limited, a company located in Hong Kong SAR, China ("Mintcast", "we", "us"). You are the person named on the account, or the organisation on whose behalf you opened it.

Payments are processed by Creem, which acts as merchant of record. Creem is not a party to your licence to use the software; it handles checkout, tax and payment collection.

2. Who may use it

You must be at least 16 years old in the EEA and the UK, at least 14 in South Korea, and at least 13 elsewhere, and legally able to enter into a paid agreement where you live. If you are using Mintcast for a company, you confirm that you are allowed to accept these terms on its behalf.

3. Your licence

Subject to these terms and to the plan you hold, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the apps on devices you own or control, for streaming and recording your own content.

This licence is for one person. It does not include the right to resell, sublicense, rent, lend or share access with anyone else, to modify or create derivative works from the software, to reverse engineer or decompile it except where the law expressly permits, or to use it to build a competing product. Commercial streaming — a company, a studio, a shop, a team of presenters — requires a commercial licence; write to us and we will set one up.

4. Accounts

  • Give us an email address you actually read, and keep it current. It is how we deliver receipts, security notices and replies to support.
  • You are responsible for what happens under your account, including on devices you have paired. Keep the password to yourself and use a password manager rather than reusing one.
  • One person, one account. Creating several accounts to get around plan limits, or to obtain more than one introductory discount, is a breach of these terms.
  • Tell us promptly if you believe someone else has access to your account. We can reset the password and end active sessions.
  • You can close your account at any time. Section 13 of the privacy policy describes what happens to the data.

5. Plans, prices and billing

5.1 Prices

Prices are shown on the pricing section of this website and are quoted in US dollars. The price that applies to you is the one displayed at checkout at the moment you buy. Applicable sales tax, VAT or similar charges are calculated by Creem based on your billing country and shown before you pay.

5.2 Free plan

The free plan has no time limit and requires no payment method. It is limited in features as described on the pricing section. We may change what the free plan includes, but we will not start charging you for it without your explicit consent.

5.3 Subscriptions and automatic renewal

Monthly and Yearly plans are subscriptions. They renew automatically at the end of each period, at the price you agreed, until you cancel. Before each renewal Creem charges the payment method on file. Where the law requires a renewal reminder, Creem sends one to the email on the order before the charge. The renewal charge is the same as the price you agreed unless we have told you about a change under 5.4.

5.4 Price changes

We may change subscription prices. A new price never applies to a period you have already paid for. For renewals, we give at least 30 days' notice by email, and you can cancel before the new price takes effect. If you do nothing, the subscription renews at the new price; if you cancel, you keep access until the end of the period already paid.

5.5 Lifetime plan

The Lifetime plan is a single payment for continued access to the software as it exists at the time of purchase, plus updates to the current major version. It is not a promise that the service will run unchanged forever, and it does not cover a future product we may release as a separate major version.

5.6 Failed payments

If a renewal charge fails, Creem retries and notifies you. Paid features may be suspended until the payment succeeds. We do not delete your account because a card expired.

6. Cancelling

You can cancel a subscription at any time, from the customer portal linked in any Creem receipt email, or by writing to support@mintcast.io from the address on the account. Cancelling stops the next charge. You keep access until the end of the period you have already paid for; we do not cut the service off the moment you click cancel.

7. Refunds

Refunds are governed by our refund policy, which forms part of these terms. In short: a 14-day money-back window on a first purchase, discretionary refunds for duplicate charges and outages, and statutory rights wherever they give you more. Refunds are executed by Creem back to the original payment method.

8. Acceptable use

You may not use Mintcast to:

  • stream or record content that is illegal where you or your audience are located, including content that sexualises minors, incites violence, or infringes someone's copyright, trademark or privacy;
  • film or broadcast a person who has not consented to being filmed, including in private spaces, changing rooms, or anywhere a reasonable person would expect not to be recorded;
  • create or spread audio or video that presents a real person saying or doing something they did not say or do, or otherwise deceive viewers about who they are watching;
  • harass, threaten, defame or dox an individual;
  • distribute malware, phishing pages or scams, or use the software to commit fraud;
  • circumvent the licence system, crack the app, or use a modified client to unlock paid features;
  • resell access, share an account commercially, or present Mintcast as your own product;
  • interfere with our servers, probe them for vulnerabilities without written permission, or place unreasonable load on them.

We may suspend or close an account that breaches this section. Where the breach is serious — content involving minors, or a deliberate attempt to defraud — we close it immediately and without a refund. Where it looks like an honest mistake, we usually warn first and explain what to change.

9. Your stream and your content

You keep all rights to what you stream and record. We claim no ownership of it, and because your video does not pass through our servers, we could not use it even if we wanted to.

You are responsible for having the rights you need: music, footage, logos, and the consent of anyone who appears on camera. You are also responsible for complying with the rules of the platform you stream to, which are often stricter than the law — for example on background music or on selling products during a live stream.

10. Background replacement and synthetic media

The background replacement feature separates a person from a background on the device. It is a visual effect, not an identity tool: it does not recognise faces and creates no biometric record. Used as intended, it changes the room behind you, nothing else.

If you use the app to publish synthetic or altered depictions of a person, you must have that person's permission, and you must disclose the alteration where the law or the platform requires it. Using the app to produce non-consensual intimate imagery, or to make a public figure appear to say something they did not say, is a serious breach and will end the account.

11. Third-party platforms

Mintcast sends your stream to platforms we do not own or control. Each has its own terms, limits and moderation. A platform may change its streaming rules, revoke access, or suspend your channel, and we cannot reverse that. We are not affiliated with, endorsed by or sponsored by any of the platforms named on this website; their names and logos belong to them.

12. Our intellectual property

The software, the website, the visual design, the built-in scenes, effect packs, text and graphics are owned by Mintcast Studio Limited or licensed to us. These terms give you a right to use the software; they do not transfer ownership of anything. You may not copy the built-in assets into another product, use our name or logo as your own, or register a domain, app name or trademark that is confusingly similar to Mintcast.

Some components are open-source software under their own licences, which prevail over these terms for those components. A list is available on request.

13. Availability and changes

We aim to keep the apps working, and we release updates that sometimes require you to update the phone app and the desktop app together. We may add, change or remove features. If we remove a feature that a plan is substantially built around, we will say so in advance and, where it matters, offer a refund or a plan change.

Older versions of the app stop being supported eventually. We will announce an end-of-support date before it happens, and the app will keep working on the old version for a reasonable period after updates end.

14. Warranty disclaimer

The software is provided "as is" and "as available". To the extent the law allows, we make no warranty that it will be uninterrupted, error-free, or fit for a particular purpose, and we disclaim the implied warranties of merchantability, satisfactory quality and non-infringement.

We do not warrant the quality of your stream, because that depends on your phone, your network, your lighting and the platform you send it to. We do not warrant that background replacement will look convincing in every condition; strong backlight, a busy background and fast movement all degrade it, and the free plan exists so you can test that before paying.

Nothing in these terms limits rights you have under mandatory consumer law in your country.

15. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, including lost profit, lost viewers, lost followers, lost business, lost data, or damage to reputation, however they arise.

Our total liability for all claims relating to the software in any 12-month period is limited to the amount you actually paid us for it in the 12 months before the event giving rise to the claim. If you are on the free plan, that amount is zero.

We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer in the EEA or the UK, this section applies only as far as your local law allows.

16. Suspension and termination

You may stop using the software at any time by uninstalling it and, if you wish, closing your account. We may suspend or terminate your access if you materially breach these terms, if we are required to by law, or if we discontinue the service. Except in cases of serious breach, we give notice first.

If we discontinue the service while you hold a paid plan, we refund the unused portion of that plan. If we terminate your account for a breach, no refund is due. Sections that by their nature should survive termination — intellectual property, disclaimers, liability, governing law — survive it.

17. Governing law and disputes

These terms are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

If something goes wrong, write to support@mintcast.io first. Most disputes are a misunderstanding about a charge or a feature, and we would rather fix it in an email than in front of a judge. If a dispute cannot be resolved that way within 60 days, either side may bring it before the courts of Hong Kong SAR.

If you are a consumer resident in the EEA, the UK, or another jurisdiction whose law gives you the right to bring proceedings in your local courts, nothing in this section takes that right away from you.

18. Changes to these terms

We may update these terms. The effective date at the top of the page shows the current version. If a change materially affects your rights or your payments, we email account holders at least 30 days before it takes effect, and you may cancel before then. Continuing to use the software after a change takes effect means you accept the updated terms.
